RULES

I.INTRODUCTION

1) The present Rules describe conditions, on which a reservation can be made and renting of lodging objects by services www.platinum24.pl and www.platinumapartments.pl
2) To make reservation is tantamount to accept the present Rules.
3) Definitions of terms used in conditions:
a) Price for service – service remuneration
b) booking form – document in electronic version, being one form of renting apartment booking by Contractor
c) apartment – residential apartment described in detail on www.platinum24.pl or www.platinumapartments.pl, which constitutes the subject of Booking.
d) Booking fee – fee in amount of 30% of price for Service, which constitutes premise of Service providing, being recognized against the Service Price.
e) Final Booking Confirmation – the form of receiving booking price
f) Contractor – Platinum Apartments – Jolanta Teresa Ciborska with seat in Wrocław ul. Dworcowa 11 “b”/9, 50-456 Wrocław, conducting internet services: www.platinum24.pl, www.platinumapartments.pl, making booking and providing Service or acting as an agent in Booking and providing Service.
g) Booking – entitlement to use an Apartment on terms described in Final Booking Confirmation and hereby terms.
h) Client – legal or natural person having capacity for legal activities as defined by regulations of Civil Code.
i) Service – service of Apartments rent described on websites: www.platinum24.pl, and www.platinumapartments.pl, which Contractor rents to Clients for residential purposes acting in his own name or in name and for authorized holders.
j) Introductory Booking Confirmation – the form of receiving registration of Client including among others amount of Booking Fee, amount of Service Price and label of account, where the Booking Fee has to be transferred.

II.BOOKING

1) The booking of object is done by filling in and sending a booking form placed on website: www.platinum24.pl, and www.platinumapartments.pl
2) Booking requires the down payment in amount of 30% of booking value.
3) Down payment can be paid on account or by email payment which are given in email confirming booking (detailed instructions are given in email confirming booking)
4) In order to confirm a booking registration, the Contractor sends on email of Client, the Introductory Booking Confirmation
5) If Contractor does not reply to the registration of Client, it means that Contractor because of the technical or organizational reasons refuses an Apartment booking.
6) Contractor sends Final Booking Confirmation on email address given by Client, not later than in 48 hours from date of receiving reservation fee on the account of Contractor.

III.“LAST MINUTE” BOOKING

1) “Last Minute” Booking is such a booking, for which a date of arrival is during first 5 days (counting from the day of submitting booking)
2) In case of “Last Minute” Booking, the down payment is not charged. The beginning day of stay, the Client has to pay full amount to the person responsible for giving the keys.
3) “Last Minute” Booking is done by filling in and sending a booking form placed on website: www.platinum24.pl, and www.platinumapartments.pl

IV.PAYMENT RULES

1) Client pays Booking Fee on the account shown in Introductory Booking Confirmation or by credit card, in way that the account of Contractor has been recognized not later than in three days from receiving Introductory Booking Confirmation, in each case not later than 2 days before first day of using the Apartment.
2) The recognition of the Contractor account by Booking fee after the deadline mentioned above, causes that the booking takes no effects.
3) Payment of the remaining Price part for Service is done on the following rules:
a) By cash, at the moment of giving the keys, or
b) By credit card, including a payment of Booking Fee or in determined installments, or
c) By bank transfer on the account of Creditor, including a payment of Booking Fee or in determined installments
4) In case, when Client decides to make payment for booking in installments (concerns cases described in point 3a and 3b), he has to contact Contractor in purpose to determine the detailed payment terms).
5) For additional services, not included in Booking, the payments are made at ordering additional services, payment can be done by cash.
6) Clients is charging for all banks transfer costs
7) In each case, the payment of full fee for stay and the recognition of the Contractor account must be done before hand over of rented apartment to the disposal of Client

V.RANGE OF RENT AGREEMENT

1) Agreement concluded between Contractor of object and Client includes only and exclusively the apartment rent.
2) Journey, food and time organization come under the Client.
3) In price of rent are included fees for media (gas, electricity, water) and final cleaning.
4) Contractor will not charge any other additional fees over those which have been shown on the website of the given apartment.

VI.CONDITIONS OF RENT APARTMENTS

1) The arrival should be in hours established with the person responsible for giving the keys.
2) Client is obliged to inform this person latest the day before arrival about planned time of keys receipt.
3) One can move in to the apartment from 14.00 p.m. on the day of arrival.
4) You have to leave apartment till noon, 12.00 a.m. the day of departure, unless it was arranged differently with the person giving the keys.
5) Client hands over the Apartment keys the last day of renting Apartment till noon, 12.00 a.m. in the place and deadline shown in Booking Confirmation or arranged by parties of agreement.
6) In case of lack of possibility to reach before arranged time, the Client is obligated to inform immediately by the telephone call the person responsible for giving the keys.
7) The Client is obligated to pay the due amount for making Booking even if, because of reasons independent of the object of Contractor , the arrival or departure will be delayed or shorten.
8) At the keys receipt to the apartment, Client shows ID Card.

VII.CLIENT’S OBLIGATIONS

1) Maximum number of persons living in object is limited as given on website of Apartment.
2) Client is obligated to inform service www.platinum24.pl, and www.platinumapartments.pl or by phone or email about any changes of this number.
3) If number of persons living in object will exceed number of persons given on website of Apartment, the person responsible for keys can refuse to give the keys for object.
4) Client is obligated to care about rules of good neighborhood and to keep Apartment in the previous conditions.
5) The Client’s duties is leaving clean dishes and kitchen utensils before departure, because this range of activities is not included in final cleaning.
6) Client is obligated to inform immediately the responsible person for giving a keys about potential damages or shortfall found in object and to report damages made by himself during stay.
7) Equivalent of damages, mentioned in point 6 and cost of its removing are covered by Client.
8) Owner of damaged property decides about the compensation way.
9) Client is obligated immediately to inform Contractor about any events, to which a Contractor can exposed. Client is obligated to pay special attention to proper operation of water valve, gas and electrical devices. Because of fire protection, Client cannot use any devices powered by electric current, not constituting the equipments of Apartment apart from: computers, electric shavers, hairdryer.
10) Smoking tobacco (cigarettes) is forbidden in Apartment, unless parties decides otherwise.
11) Client can use the Apartment only for living purposes and can’t give in further sublet without Contractor approval.

VIII.BOOKING CHANGES

1) After payment, the down payment will be not returned
2) There is possibility of changes booking date after paying down payment under condition, that this change will be done minimum 14 days before original booking date. Changes can be made only for the same object retaining the original length stay.
3) In case of changes booking date, the original booking has to be annulled by contact with Contractor, and after the new booking made with new date giving in box “Cautions” number of previously paid booking.
4) In case of choosing new date falling in more expensive season, it is required an extra charge of the price difference in price, which is paid to the person responsible for giving keys during settlement for whole stay in the day of arrival.
5) Time of stay in particular object can be extended
6) In case of extending stay, Client is obligated to inform Contractor by phone or by email.
7) In case of changes in number of persons, Client is obligated to inform Contractor by phone or by email.

IX.RIGHTS AND DUTIES TRANSFER TO ANOTHER PERSON

1) In each moment Client can transfer all his rights belonging to him by virtue of booking to another person
2) Person, mentioned in point 1) takes over all duties resulting from this Booking.
3) In such a situation the Contractor must be informed immediately about reserve change, giving personal data of the person which takes over rights and duties resulting from agreement.

X.FREE STAY OF CHILD

1) Child up to 5 (one for two adults), sleeping with adults or in own bed and not requiring bed covering does not bear any fees for stay.
2) During making booking, in application has to be chosen number of persons without taking under consideration such child, and only in box “Cautions” his age should be given.
3) Remaining children pay normal price

XI.FEES FOR ANIMALS

1) There is not possibility of keeping in apartments animals, unless on website of particular object marked, that there is possibility to take small animals, particularly dog or cat.
2) Fee for animal is 10 pln per day
3) Client is in full responsibility for eventual damages done by animal and is obligated for compensation of this damages.
4) Owner of damaged property decides about the way of compensation.

XII.FORCE MAJEURE APPEARANCE

1) In case of appearance of circumstances impossible to expect, which results cannot be immediately erased by usual means, the Contractor reserves the right to offer the Client an substitute object similar to originally booked object.
2) Contractor has a right, in case of appearance of events having a character of force majeure to annul an agreement. It also concerns cases in which Client’s personal security or his wealth, because of the reasons independent from Contractor, would not be able to be guaranteed.
3) The amounts paid by Client immediately is immediately reimbursed, with deduction of due amounts for services already rendered.

XIII.PERSONAL DATA

1) Client making booking on website: www.platinum24.pl, and www.platinumapartments.pl, hereby agrees to place his personal data in database of Contractor responsible for booking process. The data will be processed exclusively in purpose of booking execution, facilitation in making next bookings and in marketing purposes according to rules of Law of 29 August 1997 about database protection. Booking person has a right to access his personal data and to update them.

XIV.COMPETENT LAW

1) The competent Law for disputes between Contractor and Client is polish law.
2) The disputes will be decided by competent court for seat of Contractor.
